�_ D. That it will send to each labor organization or representative <br /> � of workers with which it has or is bound by a collec tive <br /> bargaining or other agreement or understanding, a notice <br /> advising such labor organizations or representative of the <br /> contractor's obligations under the Illinois Human Rights Act <br /> and the Department's Rules and Regulations. If any such labor <br /> organization or representative fails or refuses to cooperate <br /> with the contractor in its efforts to comply with such Act and <br /> Rules and Regulations, the contractor will prom�tly so notify <br /> the Department and the contrac ting agency and will recruit <br /> empl oyees from other resources when necessary to fulfil l its <br /> obl igations thereunder. <br /> E. That it will submit reports as required by the Department's <br /> Rul es and Regul ations, furnish al l rel evant informati on as may <br /> from time to time be requested by the Department or the <br /> contrac ti ng agency, and in al l respects comply wi th the <br /> Illinois Human Righ ts Act and the Department's Rules and <br /> Regulations. <br /> F. That it will permit access to all relevant books, records, <br /> accounts and work sites by personnel of the contrac ting agency <br /> and the Department for purposes of investigation to ascertain <br /> canpl iance wi th the I11 inois Human Rights Act and the <br /> Department's Rules and Regulations. <br /> G. That it will include verbatim or by reference the provisions <br /> of this clause in every subcontract it awards under which any <br /> portion of the contrac t obligations are undertaken or assumed, <br /> so that such provisions will be binding upon such <br /> subcontrac tor. In the same manner as with other provisions of <br /> this contract, the contractor will be liable for compliance <br /> with applicable provisions of this clause by such <br /> subcontractors; and further it will promptly notify the <br /> contrac ting agency and the Department in the event any <br /> subcontractor fail s or refuses to comply therewith. In <br /> addi ti on, the contrac tor wil l not uti 1 ize ar�y subcontrac tor <br /> decl ared by the I11 inois Human Rights Commissi on to be <br /> inel i gible for contracts or subcontracts wi th the State of <br /> Illinois or any of its political subdivisions or municipal <br /> corporations. <br /> 17.02. Subcontracts. With respect to subcontracts, the <br /> following definition is taken from Article 1 , Section 1 .1 (16) of the <br /> Rules and Regulations of the Illinois Human Rights Commission: <br /> The term "Subcontract" shall mean any agreement, arrangement <br /> or understanding, written or otherwise between a public consultant <br /> and any person under which any portion of the public consultant's <br /> abligations under one or more public contracts is performed <br /> undertaken or assumed; the term "subcontrac t," however, sha�l not <br /> include any agreement, arrangement or understanding in which the <br /> parties stand in the relationship of an employer and an employee, or <br /> between a bank or other financial institution and its customers. <br /> 15 <br />
