� ITEM 6. INELIGIBLE EXPENSES <br /> Ineligible operating expenses include those expenses for the <br /> fol l owi ng: (i ) depreciati on; (i i) amortizati on of any <br /> intangible costs; (iii) debt service on capital assets acquired <br /> wi th the as si stance of capi tal grant funds provided by the State <br /> of Illinois; (iv) profit or return on investment; (v) excessive <br /> payment to associated entities; (vi ) any expense eligible for <br /> federal funding under a capital program; (vii) costs reimbursed <br /> under Section 6 and 8 of the "Urban Mass Transportation Act of <br /> 1964", as amended; (viii) entertainment expenses; (ix) charter, <br /> school bus and sightseeing expenses; (x) fines and penalties; <br /> (xi ) charitable donations; (xii) interest expense on long-term <br /> borrowing and debt retirement other than on publicly-owned <br /> equipm ent and facilities; (xiii) income taxes for which the <br /> applicant is liable; (xiv) any expenses for which participant <br /> has or will receive reimbursement from any federal , state or <br /> 1 ocal program; (xv) expenses associated wi th compl i ance wi th the <br /> Single Audit Act of 1984, (31 USC Sec. 75; OMB Circular A-128); <br /> (xvi) expenses for freight haulage provided by the applicant; <br /> (xvii ) any expense which is reimbursed from insurance proceeds; <br /> (xviii) and maintenance of vehicles which are not used for <br /> public transportation or to support operations (e.g., <br /> supervisory and maintenance vehicles). <br /> ITEM 7. LIMITS OF LIABILITY AND PAYMENT <br /> The Participant agre es that the obligation of the Department <br /> under this Agreement shall not exceed the amount of the grants <br /> payable to the Participant pursuant to the provisions of this <br /> Agreement. The Participant further agrees that the Department's <br /> total obligation under the Downstate Operating As sistance G rant <br /> Program shall not exceed the amounts of the grants pa�yable to <br /> all participants upon such program pursuant to the provisions of <br /> the i r res pec ti ve agreements wi th the Department. <br /> 5 <br />
