� ' e <br /> examine and audit said records, books, and accounts at any <br /> and all reasonable times as City may elect, and TMD shall <br /> reimburse the City for any shortage or loss or overcharge, <br /> other than losses from theft, robbery or other causes beyond <br /> the control of TMD or its employees, that may be disclosed <br /> by such audit or examination. No funds shall be withdrawn <br /> from said bank, or banks, except upon the order of the City. <br /> 22 . ATE shall furnish such periodic reports and <br /> recommendations to the City as City may require or as may be <br /> deemed reasonably necessary by Operator regarding the <br /> operation, maintenance, extension, routing, service poli- <br /> cies, scheduling and other aspects of the maintenance and <br /> operation of the transit system and the improvement thereof <br /> and ATE shall annually prepare and submit to the City in <br /> such form as City may determine an operating and capital <br /> budget and projections. <br /> 23 . ATE and TNID shall carefully and reasonably use and <br /> properly maintain and keep in repair all transit system <br /> property and appurtenances of the City used by the ATE and ' <br /> TMD pursuant to this Agreement, and shall keep such mainte- <br /> nance and inspection records as may be required by City from , <br /> time to time. Said property appurtenances and records shall <br /> be made available for inspection by the City as it shall <br /> from time to time direct. <br /> 12 <br />
