. ��, 9 � --� I - AGREEliENT � THIS Agreement , by and between the City of Decatur , Illinois ("City") and Soules Bird Repellent Companq ("Soules") . For and in consideration of the mutual promise and obliga- tions made and assumed hereunder, the City and Soules agree as follows : 1 . Soules shall implement a bird removal program in the area of Decatur, Illinois , commonly referred to as the "Elms Neighborhood," bounded to Water Street on the west , to Gar- field Avenue on the south, to N. Martin Luther Ring Drive . on the east , and to Rellar Lane on the north (see map in- cluded as Eshibit A) . 2. Soules ' bird removal program shall be designed primarily for the removal of starlings and other birds designated as "pests" by the State of Illinoia Department of Public Health. 3. Soules agrees that chemical processes will not be used in the elimination of birds from the Elms Neighborhood. 4. Soules agrees that should some birds (only starlings or other birds defined as "pests" by the State of Illinois Department of Public Health) have to be killed with a pellet gun or rifle, these birds will immediately be removed from the Elms iveighborhood and disposed of in accordance with Federal, State and local law. 5 . Soules agrees to implement the bird removal program in the Elms Neighborhood for a one-year period, beginning on July 1 , 1990, and ending on June 30, 1991 . 6. Soules further a rees to decrease th g e population of starlings and other birds defined as pests by the State of Illinois Department of Public Health by 95� by October 1 , 1990. The starling and "pest" bird population will be es- timated by Suules prior to July 1 , 1990 , and shall be verified at the discretion of the City, by whatever means are available, and an estimated population shall be agreed to by Soules and the City prior to implementation of the bird removal program.
