'; <br /> ' -3- <br /> ITEM 2 - AMOUN T OF GRANT <br /> The Net Pro�ect Cost is estimated to be �41 ,000. The <br /> Department agrees to make a Grant in an amount equal to 20 percent <br /> of the actual Net Pro�ect Cost, as determined by the Department upon <br /> campletion of the Project, or in the amount of �8,200, whichever is <br /> less; provided, however, that the Department at its sole discretion <br /> may agree to increase the amount of the grant in excess of the <br /> amount specified herein in the event that the amount of the federal <br /> grant made in connection witfi this pro3ect is subsequently <br /> increased, but in no event shall the total amount provided by the <br /> Department under this Agreement or any subsequent Amendment to this <br /> Agreement exceed 20 percent of the actual Net Pro�ect Cost. No � <br /> liabili�y shall be incurred by the State in excess of the amount of ' <br /> the Grant. <br /> ITEM - 3 DOCUMENTS FORMING THIS AGREEMEN� <br /> The Parties agree that this constitutes the entire Agreement <br /> between the Parties hereto, that there are no agreements or <br /> understandings, implied or expressed, except as specifically set <br /> forth in the Agreement and that all prior arrangements and <br /> understandings in the connection are merged into and contained in <br /> this Agreement. The Parties hereto further agree that this <br /> Agreement consists of this Part I� entitled "Mass Transportation, <br /> Capital Grant Agreement", together with Part II, entitled Mass <br /> Transportation Capital Grant Agreement General Terms and <br /> Conditions", Exhibit "A", entitled "Grantee's Application", and <br /> Exhibit "B", entitled °Approved Pro�ec t Budget", all of which are by <br /> this reference specifically incorporated herein. <br />
