Bacon, Jr. , City Manager <br /> RE: Hyde Park Agreement <br /> The attached resolution and agreement between the City and <br /> Choice Properties, Inc. provides for the method of payment to <br /> finance the extension of water into this recently annexed area. <br /> It does not address the annexation itself but simply confirms the <br /> execution of the agreement between the parties for water main <br /> financing. In the absence of this agreement, the City is still <br /> obligated to provide water service to the area. <br /> At the time this agreement was originally considered, ques- <br /> tions arose about the streets which would become city maintenance <br /> obligation. These streets within Hyde Park were built according <br /> to city standards at the time of their construction and were ac- <br /> cepted as public streets. Since 1971 , these streets have been <br /> the responsibility of South Wheatland Township and accordingly <br /> will continue to be public property now that the area is within <br /> city Iimits . It is the intention of City staff to enter into a <br /> c�operative agreement with the South Wheatland Township Road Com- <br /> mission so that the Township crews will continue to perform the <br /> actual maintenance. <br /> Attachment <br />
