. <br /> Revision of Paragraph 5 - It is hereby understood and agreed that if the <br /> said detailed plans, specifications and estimates of cost are pre- <br /> sented to the City and the said detailed plans, specifications and <br /> estimates of cost are thereafter substantially changed, or revised, <br /> for any reason other than the fault of the Engineer in preparing <br /> the same, then the Engineer shall be entitled to and shall receive <br /> a reasonable additional compensation for said revisions, which <br /> amount shall be due and payable upon the completion of said revisions. <br /> Detailed Paragraph 6 - During the period of performance of sub-surface <br /> Resident explorations and also of construction of said improvements, the <br /> Engineer shall furnish detailed resident inspection services <br /> acceptable to the City. Such resident inspection shall contemplate <br /> the furnishing of a full-time resident engineer (and/or inspectors <br /> as necessary) for the period of active construction of the project. <br /> The Engineer shall provide those services which are customarily re- <br /> ferred to as detailed resident inspection services provided that <br /> the Engineer shall not be responsible for the acts or omissions of <br /> any contractor(s) , any subcontractor(s) or any of the contractor(s) ' <br /> or subcontractor(s) ' agents or employees or any other persons <br /> (except his own employees and agents) at the project site or for <br /> the supervision, direction, control and work safety of any contractor(s) <br /> or for the construction means, methods, techniques, sequences, or <br /> procedures or for safety precautions or programs incidental to the <br /> work of contractor(s) or for any contractor(s) ' failure to perform <br /> the construction work in accordance with contract documents. <br /> The compensation due the Engineer for furnishing Detailed <br /> Resident Inspection Services required under the provisions of this <br /> Paragraph shall be computed at payroll cost of each representative <br /> assigned to the work times a multiplier of one and ninety two hun- <br /> dredths (1 .92) plus direct out-of-pocket expense at cost and trans- <br /> portation furnished the Resident Inspector(s) at the rate of Two <br /> Hundred Dollars ($200.00) per month or Twelve Dollars ($12.00) <br /> per day for any fraction of a calendar month. <br /> Special Paragraph 7 - Property, boundary or right-of-way acquisition <br /> Engineering surveys and/or descriptions and services pertinent to easement <br /> ac,quisition and court testimony shall be considered special services <br /> and will be furnished by the City. Provided, however, if necessary <br /> to the proper conduct of the said improvements, the City may elect to <br /> instruct the Engineer to provide the special services outlined herein. <br /> The submittal of "As Built" drawings may be required by the City of <br /> Decatur. "As Builts" to include all utilities either constructed as <br /> a part of the improvement or adjusted during construction. All re- <br /> visions to plans from design to be shown. <br /> When instructed by the City to furnish such special services, the <br /> compensation due the Engineer for services rendered under the pro- <br /> visions of this Paragraph shall be "Payroll Cost" times a multiplier <br /> of 2.0 for general overhead and profit plus "direct expenses"at net <br /> cost. "Payroll Cost" is defined as the cost of salaries plus fringe <br /> costs including:social security contributions, unemployment,excise and <br /> payroll taxes, workmen's compensation, health and retirement benefits, <br /> bonuses, sick leave, vacation and holiday pay applicable thereto. <br /> -4- <br />
