f. Audit and Inspection. The Recipient shall permit the <br /> Secretary and the Comptroller General of the United States, or <br /> any of their duly authorized representatives to inspect all work, <br /> materials, payrolls, and other data and records with regard to <br /> the Project, and to audit the books, records, and accounts of <br /> the Recipient and its contractors with regard to the Pro�ect. <br /> In the case of contracts awarded under other than competitive <br /> bidding procedures as defined by the Secretary of Transportation, <br /> the Recipient shall require those contractors to permit the <br /> Secretary of Transportation and the Comptroller General of the � <br /> United States, or any of their duly autharized representatives to ' <br /> inspect all work, materials, payrolls, and other data and records <br /> with regard to the Project, and to audit the books, records, and <br /> accounts pertaining to such contracts with regard to the Project. • <br /> A Recipient that is a State or local government or Indian tribal <br /> government shall be responsible for meeting the audit requirements <br /> of 49 C.F.R. § 18 . 26 and OMB Circular A-128 or any revision or <br /> supplement thereto. Pursuant to Departmental criteria, the <br /> Government (UMTA) may waive the OMB Circular A-128 audit <br /> requirement or substitute a requirement for a grant audit <br /> performed in accordance with the Comptroller General 's standards. <br /> The Recipient is responsible for obtaining any audits required by <br /> the Government (UMTA) . Closeout of the Project will not alter the <br /> Recipient's audit responsibilities. To the extent that the <br /> charges for such audits are necessary for the administration and <br /> management of functions related to the Project, the costs of such <br /> audits are allowable under this Project to the extent authorized <br /> by OMB Circular A-87, Revised; OMB Circul�r A-21, Revised; <br /> OMB Circular A-122 , Revised; or 48 C.F.R. Part 31, as may be <br /> applicable. <br /> Section 105. Payments. <br /> a. Request by the Recipient for Payment. The Recipient may make <br /> a request for payment of the Federal share of allowable costs, and <br /> the Government (UMTA) will honor such a request in the manner set <br /> forth in Section 105 of this Part II of the Agreement. Each <br /> payment made to the Recipient must comply with 31 C.F.R. Part 205. <br /> To receive a Federal assistance payment, the Recipient must: <br /> (1) Have demonstrated or certified that it will provide <br /> local funds adequate, when combined with Federal payments, to <br /> cover all costs to be incurred under the Project. If a Recipient <br /> is required by Federal st�tute or this Agreement to provide a <br /> local share, the Recipient may not request or obtain Federal funds <br /> in excess of the amount justified by the local share that has been <br /> provided. The Recipient may not tak� any action that would cause <br /> the proportion of Federal funds made available to the Project at <br /> any time to exceed the percentag� authorized under the Agreement. <br /> Any exception to •this requiremFnt must be set forth in writing by <br /> the Government and signzd by tri� UMTA Administrator or his or her <br /> authorized designee. <br /> Page 6 <br />
