D. , 19�, by and between the State of Illizois , acting by and through its Department of Transportation hereinafter called the STATE, and the City of Decatur , of the State of Illinois , hereinafter calle3 the CITY. . WITN.ESSETH WHEREAS,� the ST�TB and the CITY have entered into an Agreement executed�_ September 19 , 1938 , which sets forth certain provisions for improving Illino_s Routes �48 and 105 from Business U . S . 51 to _ Borcher ' s Cornez� and rrom Borcher ' s Corner to . U. S . 51 South of � D�ecatur , ar�d � . " � ' : WHEREAS , the STATE and the CITY desire to supplement said 9greement , and , WHEREAS , the CITY is desirous of including additional improvements -to the project in the way of adjusting �aater service lines and appurtenances . , _ ?�'OjJ, THEREFORE, in consideration of the mutual covenants contained here and in the Agreemeat executed September 19 , 1988 , the parties hereto agree as follows : l . The STATE agrees to pay all construction and engineering costs , subject to reimbursement by the CITY as hereinafter � . stipulated , for the adjustment of the CITY ' S water service lines and appurtenances (water valves , water hydrants , and manholes ) . = 2 . The CITY agrees to reimburse the STATE for 100% of all engineering and construction costs , for the adjustment of water service lines and appurtenances . The total estimated , cost to the CITY �s $23 , 000 . 00 . Actual costs based on contract unit prices and final quantities shall be used in the final division of costs for billing and final reimbursement . �
