AMENDMENT NO. 1 TO AN AGREEMENT BETWEEN THE STATE OF ILLINOIS DEPARTN�NT OF TRANSPORTATIOT AND CITY OF DECATUR, ILLINOIS Contract Number 1532 OP-90-OS-IL This Amendment No. 1 to an Aqreement dated July 5, 1989 between the State of Illinois , Depattment of Ttansportation and the • City of Decatur, Illinois is made and entered into by and between the parties thereto. In consi8eration of the mutual covenants contained herein and in such Agreement, the patties aqree chanqes as follows: 1. To amend Part I - "DOWNSTATE OPERATING ASSISTANCE GRANT PROGRAM AGREEMENT" by addinq the followinq: ITEM 1. GRANTS. PAYMENTS. AND LIMITATIONS Subject to the terms and conditions of the Act. the approval letter issued by the Department and herein incorporated as Appendix A, the Rules and this Agreement, the Department shall make qrants to the Participant in an amount within the following limitations : 1) not to exceed 45$ of the participant 's eliqible operatinq expenses incurted by the Participant durinq fiscal year 1990 in the provision of such public transportation services as have been appzoved by the Department; and 2) shall not exceed the 1990 appropriation (�1.182.987) for the patticipant; provided howevez that under no circumstances may the state fundinq under this aqreement togethet with any federal tunding f or operatinq deficits received by the Participant f or fiscal year 1990 exceed the Participant ' s actual operating deficit for that year. In the event that the combine�f state and federal operatinq assistance qrants f or FY 90 exceed the Participant 's actual deficit, then the Participant shall request a decrease in the state fundinq and shall remit to the state any excess funds received .
