14) INDEMNIFICATION <br /> For and in consideration of the mutual covenants contained <br /> herein the CITY forever agrees to save harmless and indemnify the <br /> DISTRICT, its administrators , servants or employees , directors , <br /> trustees , contractors and/or subcontractors , agents and assigns , <br /> from any and all claims which may hereafter be presented by anyone <br /> for loss, damage, and property or personal injury as a result of <br /> the DISTRTCT' S obligations under this agreement . <br /> The CITY agrees to be responsible for the cost of any <br /> settlements , judgements or verdicts resulting from any and all <br /> claims against the DISTRICT due to the DISTRICT' S obligation <br /> herein. The CITY also agrees to be responsible for defending the <br /> DISTRICT against any and all claims and the cost associated with <br /> the defense, including but not limited to attorneys fees . <br /> 15) DEFAULT QF AGREEMENT <br /> In case of default, the CITY agrees to pay all expenses , <br /> attorney fees and associated costs that the DISTRICT may incur <br /> in enforcing the terms of this agreement. <br /> 16 ) BINDING COMMITMENT <br /> The CITY hereby represents and warrants that, to the extent <br /> provided by law, this Agreement shall be fully binding upon the <br /> CITY, and its successors and assigns , for the entire term thereof . <br /> 9 of 29 <br />
