<. � <br /> INTERGOVERNMENTAL COOPERATION AGREEMENT <br /> Between the Sanitary DISTRICT of Decatur, Decatur, Illinois <br /> a Municipal Corporation, and the City of Decatur, <br /> Decatur, Illinois a Municipal Corporation <br /> Both of Macon County, Illinois , for Rehabilitation <br /> of the Broadway sewer ( South Combined Sewer outfall ) , <br /> Cantrell Street Sewer (Combined Sewer Outfall ) , and the <br /> Cantrell Street Trunk Sewer. <br /> THIS AGREEMENT made this `1�� Day of_�Ee��z�A�.�f , 1990, is between <br /> the Sanitary DISTRICT of Decatur, Illinois a municipal <br /> corporation, Macon County, Illinois ( "DISTRICT" ) and the City of <br /> Decatur, Decatur, Illinois a municipal corporation, Macon County, <br /> Illinois ( "CITY" ) . <br /> WHEREAS, PURSUANT TO Article VII , Section 10 of the 1970 <br /> Constitution of the State of Illinois , and the Illinois <br /> Intergovernmental Cooperation Act ( 111 . Rev. Stat . 1987 , Ch. 127 , <br /> Sec . 741 Et seq. ) , units of local government in the State of <br /> Illinois may contract between themselves to obtain or share <br /> services a:id to exercise or combine functions which either of the <br /> units of local government are authorized by law to perform; and <br /> WHEREAS, the CITY presently owns and operates the Broadway <br /> Sewer ( South Combined Sewer Outfall ) , the Cantrell street Sewer <br /> (Combined sewer outfall ) , and the Cantrell Street Trunk Sewer. <br /> These sewers are depicted on the Sewer Rehabilitation Report map <br /> attached hereto marked (Exhibit 'A' ) ; and <br /> WHEREAS, these sewers are designed to transport combined <br /> sewer overflow to the DISTRICT' S proposed Lincoln Park Combined <br /> Sewer Overflow Facility for treatment; and <br />
