AGREEMENT <br /> This Agreement is entered into by and between the State of Illinois, acting through <br /> its Department of Transportation, hereinafter referred to as the STATE, Macon County of <br /> the State of Illinois, hereinafter referred to as the COUNTY, the City of Decatur of the <br /> State of Illinois, hereinafter referred to as the CITY, Archer Daniels Midland Company <br /> operating in the City of Decatur, hereinafter referred to as ADM, and Richland Community <br /> College in Macon County, hereinafter referred to as the COLLEGE. <br /> WITNESSETH <br /> WHEREAS, the parties hereto, in order to facilitate the free flow of traffic and <br /> insure safety to the motoring public are desirous of performing an engineering study on <br /> Brush College Road from Illinois Route 48 southerly to and including the intersection of <br /> Fairies Parkway to determine the cross section and intersection designs to provide <br /> sufficient capacity. Said study to be identified as COUNTY Section 89-00119-00-ES, and <br /> STATE Job Number P-95-012-90 for Phase I preliminary engineering, and hereinafter <br /> referred to as the PROJECT, and � � <br /> WHEREAS, the parties hereto are desirous of said PROJECT in that same will be of <br /> imnediate benefit to the residents of the area and permanent in nature. <br /> NOW, THEREFORE, in consideration of the mutual covenants contained herein, the <br /> parties hereto agree as follows: <br /> 1 ) It is mutually agreed that the PROJECT will be processed in accordance with the <br /> Motor Fuel Tax policy and procedure with the COUNTY as the lead agency. <br /> 2) The COUNTY agrees to select a consulting engineering firm and at PROJECT expense <br /> cause any necessary surveys, intersection design studies, and reports to be made to <br /> determine cross section, intersection improvements, and cost of the proposed <br /> improvement. The COUNTY further agrees to pay all costs subject to reimbursement <br /> from the CITY, the COLLEGE, ADM, and the STATE. <br /> 3) The STATE agrees to provide STATE funds in exchange for Decatur Urbanized Area <br /> Federal-Aid Urban funds for 75� of the cost of the engineering study. <br /> 4) The CITY agrees to reimburse the COUNTY for 25% of the matching cost for the <br /> exchanged funds (6.25� of the total cost) as set forth in the Division of Cost. <br /> 5) The COLLEGE agrees to reimburse the COUNTY for 25% of the matching cost for the <br /> exchanged funds (6.25� of the total cost) as set forth in the Division of Cost. <br /> 6) ADM agrees to reimburse the COUNTY for 25% of the matching cost for the exchanged <br /> funds (6.25� of the total cost) as set forth in the Division of Cost. <br /> 7) The parties hereto mutually agree that the estimated division of cost is as follows: <br /> DIYISION OF COST <br /> EXCHANGED <br /> FUNDS (�) COUNTY (�) CITY (%) COLLEGE (%) ADM 9(�) TOTAL <br /> Preliminary <br /> Engineering �75,000 (75) $6,250 (6.25) �6,250 (6.25) $6,250 (6.25) �6,250 (6.25) �100,000 <br />
