� � � - �� � AMENDMENT N0. 1 TO AN AGREEMENT BETWEEN THE STATE OF ILLINOIS DEPARTMENT OF TRANSPORTATION AND THE CITY OF DECATUR (Contract No. 1096) PROJECT CAP-85-269-FED This Amendment No. 1 to an Agreement dated December 31 , 1985 between the State of I11 i noi s, Departinent of Transportati on and the City of Decatur is made and entered into by and between the parti es thereto. In consi derati on of the mutual covenants contained herein and in such Agreement the Parties agree as fol l ows: 1 . To amend Part I - "Mass Transportation Capital Grant Agreement" by adding the following ITEM 4 - ILLINOIS GRANT FUNDS RECOVERY ACT Thi s grant i s subj ect to the I11 i noi s Grant Funds Recovery Act, Public Act No. 83-640. This Grant is valid until July 1 , 1991 and grant funds are available to grantee and may be expended by grantee until said date unl ess the Depart�nent, at i ts di screti on, grants an extension of time. Any grant funds which are not expended or legally obligated by the grantee at the end of the grant agree+nent or by the expi rati on of the peri od of time grant funds are avai 1 ahl e for expendi ture or obligation, whichever is earlier, shall be returned to the Department wi thin 45 days. Project cl oseout shall be in accordance with Item 110 of this agreement. The parties hereto agree that the Agreement dated December 31 , 1985 between the Parties is in all other respects ratified and reaffirmed and that it continues in full force and effect as hereby amended.
