R89-74 AUTHORIZING THE EXECUTION OF A DOWNSTATE OPERATING ASSISTANCE AGREEMENT FOR MASS TRANSIT FOR FY '90

- DOWNSTATE OPERATING ASSISTANCE AGREEMENT This Agreement is made by and between the State of Illinois, acting by and through the Division of Public Transportation, in the State of Illinois Department of Transportation (both hereinaf ter collectively referred to as the "Departanent") ; and the Decatur Public Transit System with offices at No 1 Civic Center Plaza, Decatur, Illinois, 62523, (hereinafter referred to as the "Participant," which term shall include its successors and assigns) . WHEREAS, the Participant is a city, village, incorporated town or local mass transit district, located outside the boundaries of the Regional Transportation Authority as established pursuant to the "Regional Transportation Authority Act," approved December 12, 1973, as amended, which during fiscal year 1979: (a) served an urbanized area of over 50,000 ' population, or (b) received State mass transportation operating assistance pursuant to the Downstate Public Transportation Act, as amended, or (c) received Federal research, development, and demonstration funds pursuant to Section 6 of the "Urban Mass Transportation Act of 1964, as amended; and WHEREAS, the Participant is an eligible participant under the terms of Arti cl e I I of the "Downstate Publ i c Transportati on Act," as amended, ( I11 . Rev. Stat. 1985, Ch. 111 2/3, Par. 661 et seq.) , hereinafter called the "Act"; and WHEREAS, the Participant has applied to the Department for operating assistance grants in accordance with the Act and the "Downstate Public Transportation Operating Assistance Program" manual (July 1985) issued by the Department (hereinafter referred to as the "Standard Forms") ; and WHEREAS, the Department has certified to the Illinois Department of Revenue that the Participant is an eligible participant under the Act, and has further certified to said Department the boundaries of the Participant; and
