C O N T R A C T <br /> THIS AGREEMENT, made and concluded this lst day of May, <br /> 1989, between the City of Decatur, Illinois, acting by and <br /> through its Council, hereinafter called "Owner" , and DUNN COM- <br /> PANY, his/their executors, administrators, successors or assigns , <br /> hereinafter called "Contractor. " <br /> WITNESSETH: That for and in consideration of the payments <br /> and agreements mentioned in the proposal for the improvement of- <br /> ficially known as Furnishing Class I and Cold Mix Asphalt - 1989, <br /> hereto attached, to be made and performed by the Owner, and ac- <br /> cording to the terms expressed in the bond referring to this <br /> agreement, the Contractor agrees with the Owner at his/their own <br /> proper cost and expense to do all the work, furnish all materials <br /> and labor necessary to complete the work in accordance with the <br /> plans and specifications hereinafter described, and in full com- <br /> pliance with all of the terms of this agreement and the require- <br /> ments of the Engineer under it. <br /> And it is also understood and agreed that the Notice to Con- <br /> tractors , Proposal, Standard Specifications , Supplemental <br /> Specifications , Special Provisions , Contract Bond , and Plans <br /> hereto attached are all essential documents of this contract and <br /> are a part thereof. <br /> IN WITNESS WHEREOF , the said parties have executed this <br /> agreement on the date above mentioned. <br /> THE CITY 0 ECATUR, ILLINOIS <br /> By <br /> TEST: MAYOR <br /> , <br /> � <br /> TY CLERR <br /> DU COMPANY <br /> �—� <br /> � <br /> By <br /> �f I �; ; President <br /> � <br /> ; <br /> � <br /> ecretary (Corporate Seal) <br />
