L' .. � <br /> � <br /> ' AGREEMENT <br /> THIS AGREEMENT, made and concluded this 20th day of <br /> February , 1989, between the City of Decatur, Illinois, <br /> acting by and through its Council, hereinafter called "Owner" , <br /> and Motorola Communications and Electronics, Inc. , their <br /> executors, administrators, successors or assigns hereinafter <br /> called "Contractor" . <br /> WITNESSETH: That for and in consideration of the payments <br /> and agreements mentioned in the following described documents: <br /> 1) Purchase Specification dated October, 1988 prepared by <br /> Sachs/Freeman Associates; <br /> 2) Memo dated October 31, 1988 from Bernhard Ebstein and <br /> Addendum No. 1 to Specifications attached thereto; <br /> 3) Memo dated November 8 , 1988 from Bernhard Ebstein and <br /> Addendum No 2. to Specifications attached thereto; <br /> 4) Contractors Proposal dated November 30 , 1988; <br /> 5) Letter of Clarification dated February 13 , 1989 to the <br /> City of Decatur from Richard L. Donahue, District Sales Manager <br />. of Motorola; and, � <br /> 6) Contract Bond, <br /> regarding the improvement officially known as City of Decatur, <br /> Illinois, Public Safety Communication System, which documents are <br /> hereto attached and hereby made a part hereof, and which payments <br /> and agreements are to be made and performed by the Owner, and <br /> according to the terms expressed in the bond referring to this <br /> agreement, the Contractor agrees with the Owner at his/their own <br /> proper cost and expense to do all the work, furnish all materials <br /> and documents herein described and in full compliance with all <br /> the terms of the agreement and the requirements of the City' s <br /> designat�d Project Manager under it. <br /> IT WITNESS WHEREOF, the said parties have executed this <br /> agreement on the date above mentioned. <br /> THE CITY O �TUR, ILLINOIS <br /> By <br /> MAYOR <br /> ATTEST: <br /> � <br /> CITY C ERK <br />
