Excerpt from City Plan Commission Minutes of November 4 , 1993
Cal. No. 93-75 Petition of STEVE HORVE to rezone a tract
of land commonly known as 930 West McKinley
Avenue from R-1 Single Family Residence
District to R-6 Multi-family Residence
. District.
Mr. Phillip Cochran, Consulting Engineer, was present and spoke
for the petition representing Mr. Horve. Mr. Cochran stated that
the subject tract is one acre located on the north side of
McKinley, west of Twin Oaks, and the request is to rezone the
property from R-1 to R-6. The Comprehensive Plan for the City of
Decatur designates this area as high density residential and R-6
is consistent with the plan. The adjacent area to the north and
east is an existing R-5 Residence Development Plan known as Twin
Oaks. To the west is an O-1 zone which allows R-6. To the south
and east is an R-6 development called Country Trails.
Mr. Cochran stated that the density for the proposed development
is consistent with the Comprehensive Plan and the development
will be the best use of the property.
Mr. Swartz expressed concern regarding the entrance located on
McKinley and the nearby crest of a hill. Mr. Cochran stated that
the sketch plan to be submitted will show the details regarding
existing topography and sight distance.
There were no objectors present.
Mr. McQueen presented the recommendation of staff:
The subject petition requests that premises commonly known as 930
West McKinley Avenue be rezoned from R-1 Single Family Residence
District to R-6 Multiple District. Containing approximately one
acre, the area in question is presently vacant. The proposal as
submitted is to construct one apartment building on the premises.
Adjoining land to the north and east is zoned R-5 Two Family and
is developed under a Residence Development Plan as the Twin Oaks
Apartment complex. Property to the immediate west is zoned O-1
Office District and is vacant while property to the south across
McKinley Avenue is zoned R-1 Single Family and is vacant. The
Comprehensive Land Use Plan identifies the subject tract and
these adjoining areas as being desirable for high density
residential dvelopment.
Considering the existing land use and zoning patterns as noted,
staff is of the opinion that the proposed zone would be
consistent and compatible with the general area. Further, we
note that the adjoining O-1 land could be developed with '
apartments without any further zoning action.
