That there is hereby reserved in, over, along <br /> and under the above-described portion of said alley to the City <br /> of Decatur, Illinois, and to the public and to those utilities <br /> and companies as the case may be owning public service <br /> facilities, mains, sewers, telephone and electric or other public <br /> utilities, such property, rights of way and easements as are or <br /> may be necessary or desirable for continuing public service by <br /> mains of such facilities and for the maintenance, renewal and <br /> reconstruction thereof with the right of ingress and egre�s for <br /> such proposes. <br /> Section 3 . That use of the easement provided for hereby is <br /> expressly limited and conditioned as follows: <br /> 1. Such easement is solely for the purpose of <br /> installing, maintaining and operating underground cable <br /> lines, conduits or other underground installations and <br /> facilities ("utility lines") , and the use of same for <br /> aboveground utility lines is prohibited; <br /> 2 . Such use for the installation, maintenance or <br /> operation of utility lines shall be at the sole risk of <br /> the utility or other person or entity owning such <br /> utility lines, and such owner shall release and hold <br /> harmless the City of Decatur for any damage to same <br /> caused by the construction or operation of City <br /> buildings or services within said easement; and, <br /> 3 .
