M �� ORDINANCE NO. o — ORDINANCE AUTHORIZING LAND ACQUISITION - MARTIN LUTHER KING JR. DRIVE - - CITY PROJECT 9113 - WFiEREAS, the City of Decatur, Illinois, owns and maintains a municipal street system, as defined at I11.Rev.Stat. 1991, ch. 121, par. 2-104; and, WHEREAS, one of the streets in said system is Martin Luther King Jr. Drive ("MLK Jr. Dr. ") , which street currently has its northern terminus at or near East Pershing Road in the City of Decatur, Illinois (except for a small,� non-contiguous portion thereof located south of East Mound Road in the City of Decatur, Illinois) ; and, WHEREAS, the Council of said City intends to extend MLK Jr. Dr. north from East Pershing Road to Shutter Drive, in the City of Decatur, Illinois; and, Exhibi A whi h Exh ' WHEREAS, the premises described in t , c ibit A is hereto attached and hereby made a part hereof, are suitable and desirable for the location and construction of said extension of MLK Jr. Dr. , and said premises are located wholly within the corporate limits of said City; and, WHEREAS, access to Martin Luther King Jr. Drive from those parcels or lots from which said premises are taken or acquired by the City should be restricted; and, WHEREAS, it is necessary and desirable that said premises and said access rights be acquired for the purpose aforesaid. NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1 . That it is, and it is hereby determined to be, necessary and desirable that the City, in order to extend said MLK Jr. Dr. as aforesaid, acquire title to the real property described in Exhibit A hereto, including access rights from the remaining parcels or lots as described above. Section 2 . That it is hereby determined that the aforesaid real property, including access rights , and the acquisition thereof is necessary for a public use and purpose.
