. . , � �U <br /> ORDINANCE NO. �� � <br />' ORDINANCE AUTHORIZING LAND ACQUISITION <br /> - MARTIN LUTHER KING JR. DRIVE - <br /> - CITY PROJECT 9113 - <br /> WHEREAS, the City of Decatur, Illinois, owns and maintains a <br /> municipal street system, as defined at Ill.Rev.Stat. 1991, ch. <br /> 121 , par. 2-104; and, <br /> WHEREAS, one of the streets in said system is Martin Luther <br /> King Jr. Drive ("MLK Jr. Dr. ") , which street currently has its <br /> northern terminus at or near East Pershing Road in the City of <br /> Decatur, Illinois (except for a small, non-contiguous portion <br /> thereof located south of East Mound Road in the City of Decatur, <br /> Illinois) ; and, <br /> WHEREAS, the Council of said City intends to extend MLK Jr. <br /> Dr. north from East Pershing Road to Shutter Drive, in the City <br /> of Decatur, Illinois; and, <br /> WHEREAS, the premises described in Exhibit A, which Exhibit <br /> A is hereto attached and hereby made a part hereof, are suitable <br /> and desirable for the location and construction of said extension <br /> of MLK Jr. Dr. , and said premises are located wholly within the <br /> corporate limits of said City; and, <br /> WHEREAS, it is necessary and desirable that said premises be <br /> acquired for the purpose aforesaid. <br /> NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE <br /> CITY OF DECATUR, ILLINOIS: <br /> Section 1 . That it is, and it is hereby determined to be, <br /> necessary and desirable that the City, in order to extend said <br /> MLK Jr. Dr. as aforesaid, acquire title to the real property <br /> described in Exhibit A hereto. <br /> Section 2. That it is hereby determined that the aforesaid <br /> real property and the acquisition thereof is necessary for a <br /> public use and purpose. <br /> Section 3 . That the City Manager and the Corporation <br /> Counsel, jointly and severally, be, and they are hereby, <br /> authorized and directed to cause said real property to be <br /> acquired on behalf of the City, and in the event the same is not <br /> able to be acquired by agreement with the owner or owners thereof <br /> upon the compensation or consideration to be paid or furnished <br />
