. . p <br /> _ ORDINANCE N0. p — J <br /> ORDINANCE VACATING AN ALLEY <br /> LYING NORTH OF HAY STREET, SOUTH OF MEMORIAL DRIVE <br /> AND BETWEEN NORTH EDWARD AND NORTH UNION STREETS <br /> WHEREAS, a request has been received from Decatur Memorial <br /> Hospital and Decatur Memorial Foundation, owners of property <br /> abutting thereon, requesting the vacation by the City Council of <br /> that alley in the City of Decatur, Illinois described as: <br /> Beginning at the Northwest corner of Lot One (1) of <br /> Brueck & Akers Addition as per Plat recorded in Book 149 <br /> Page 25 of the records in the Recorder' s Office of <br /> Macon County, Illinois, thence South to the Southwest <br /> corner of Lot 12 of said Addition, thence West 16 feet <br /> alonq the north right-of-way line of Hay Street to the <br /> Southeast corner of Lot 11 of said Addition, thence <br /> North to the Northeast corner of Lot 2 of said Addition, <br /> thence East 16 feet along the South right-of-way line of <br /> Memorial Drive to the place of beginning, situated in <br /> the City of Decatur, Macon County, Illinois; and, <br /> WHEREAS, said alley is no longer useful to the public or to <br /> the City or to the owners of the property abutting thereon as an <br /> alley; and, <br /> WHEREAS, the public interest will be subserved by vacating <br /> said alley and the public will be relieved from the further <br /> burden and responsibility of maintaining the same. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS : <br /> Section l. That the above described alley be, and the same <br /> is hereby, vacated as a public alley inasmuch as the same is no <br /> longer required for public use and the public interest will be <br /> subserved by such vacation, said alley being shown on the plat <br /> thereof hereto attached and hereby made a part hereof. <br /> Section 2 . That there is hereby reserved in, over, along <br /> and under the above-described alley to the City of Decatur, <br /> Illinois, and to the public and to those utilities and companies <br /> as the case may be owning public service facilities, mains, <br /> sewers, telephone and electric or other public utilities, such <br /> property, rights of way and easements as are or may be necessary <br />
