Decatur shall dismiss, with prejudice, its above <br /> referenced ordinance violation complaint against Hyde Park. ' <br /> 2 . Hyde Park shall dismiss, with prejudice, its counter- <br /> claim against Decatur in the above referenced matter . <br /> 3 . Decatur shall vacate the streets located in the Hyde Park <br /> Mobile Home Park, and Hyde Park shall become the owner of the i <br /> streets . <br /> 4 . After the streets have been completely vacated, Hyde Park <br /> shall be responsible for the repairs, maintenance, snow removal, <br /> and supervision of these streets . <br /> 5 . Decatur agrees to accept $63 , 000 as the total amount due <br /> from Hyde Park for the contribution from Hyde Park for the <br /> extension of City water service to Hyde Park. <br /> 6 . The $63 , 000 that Hyde Park is indebted to Decatur shall <br /> be paid in the following installments : <br /> A. $34, 006 . 1b upon signing of this Agreement . <br /> B. The remainder in six equal annual installments on the <br /> anniversary date of this Agreement of $4, 832 .31 plus <br /> interest at 10� . <br /> 7 . Decatur agrees to make Hyde Park a commercial designation <br /> for the purposes of refuse removal immediately upon signing of this <br /> Agreement . <br /> 8 . That Hyde Park is concerned that upon an amendinent to the I <br /> refuse removal that they may subsequently be designated as a <br /> residential account . � <br />
