LEGAL DEPARTMENT MEMORANDUM
No. 92-28
August 26 , 1992
T0: Honorable Mayor and City Councilmembers
.-
FROM: James C. Ba, Jr. , City Manager
John W. Couter, Corporation Counsel
RE: Hyde Park
In November, 1991, the City entered into an agreement
with Downing Street Limited Partnership, the owner of Hyde
Park Mobile Home Park, regarding certain matters pertaining
to the Park. (A copy of this agreement is forwarded to the
Council herewith. ) Among other things, the City agreed to
vacate the streets located in the park, which streets
Downing Street would thereafter maintain. Pursuant to this
agreement, Downing Street has petitioned for the vacation of
these streets and an ordinance which would effect same is
accordingly before the Council for its consideration.
It should be noted that four (4) lots within the Park
do not belong to Downing Street, and the owners of these
lots have not petitioned for vacation of the streets.
However, these lots will continue to have full access to
these streets after vacation and will suffer no loss or
inconvenience.
Staff recommends approval of the vacation ordinance.
JWC:pm
