-3-
 III
The effect of an order admitting a will to probate is to vest
title to the property in the devisees. Title is not vested in the
executor or co-executos of the estate. Title is vested in the
devisee, as completely as a deed from the owner of property vests
title in his grantee. Scott v. Scott, 179 I11 App 3d 487 (1919) .
IV
Finally, "contiguity" is satisfied by a touching or adjoining
in a reasonable substantial physical sense. In re Annexation to
Villaqe of Buffalo Grove, 128 I11 App 2d 261. The territory sought
to be annexed is clearly contiguous.
ORDER
The Court finds (1) the property described in the petition is
contiguous to the city of Decatur; (2) the petition is signed by
the requisite number of electors and property owners of record; and
(3) that the description of the territory contained in the petition
is adequate in law. The question of annexation is thereby ordered
submitted to the corporate authorities of the City of Decatur and
a copy of this order is ordered sent by the Clerk of the Court to
the Clerk of the City of Decatur. A op of this order is also
ordered submitted to co sel o pet tion and objectors.
1' J N L. DAVIS, Circuit Judge
Enter:
