� <br /> i� f <br /> ORDINANCE N0. � �— �Q �" <br /> ORDINANCE AMENDING SPECIAL USE PERMIT <br /> - M-2 EXTRACTIVE USE - <br /> - SOUTHSIDE DRIVE - <br /> WHEREAS, on the 2nd day of July, 1992, upon due notice, <br /> the Decatur City Plan Commission held a public hearing upon <br /> the petition of Vulcan Materials Company, owner of the <br /> premises described herein on Exhibit A hereto, to amend and <br /> modify a special use permit for the extraction of sand and <br /> gravel granted by Ordinance No. 5991, and subsequently <br /> amended by Ordinance Nos. 87-115 and 88-101; and, <br /> WHEREAS, said Decatur City Plan Commission did report <br /> its findings and did recommend that the modification of said <br /> special use permit as requested by authorized. <br /> NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF <br /> THE CITY OF DECATUR, ILLINOIS: <br /> Section 1 . That the report and recommendation of the <br /> Decatur City Plan Commission be, and the same are hereby, <br /> received, placed on file and approved. <br /> Section 2. That said Ordinance No. 88-101 be, and the <br /> same is hereby modified and amended by substituting Exhibits <br /> B and C attached hereto and hereby made a part hereof, for <br /> and in lieu of Exhibits B and C, respectively, of said <br /> Ordinance No. 88-101, for the purposes of said former <br /> Exhibits as therein expressed. � <br /> Section 3 . That said Ordinance No. 88-101 be, and the <br /> same is hereby further modified and amended by adding <br /> Section 4 thereto, said Section 4 to provide as follows: <br /> "That if the Director of Public Works determines that <br /> airborne dust is not being controlled, then Vulcan shall <br /> cease operation until the problem is corrected to the <br /> satisfaction of the Director of Public Works. " <br /> Section 4 . That except as modified by the provisions <br /> hereof, the special use permit heretofore granted by <br /> Ordinance No. 5991 and subsequently amended by Ordinance No. <br /> 87-115 and 88-101 remains in full force and effect, and the <br /> same remains subject to all the conditions, limitations and <br /> restrictions set out in the ordinance aforesaid, as amended <br /> hereby. <br />
