� i� f ORDINANCE N0. � �— �Q �" ORDINANCE AMENDING SPECIAL USE PERMIT - M-2 EXTRACTIVE USE - - SOUTHSIDE DRIVE - WHEREAS, on the 2nd day of July, 1992, upon due notice, the Decatur City Plan Commission held a public hearing upon the petition of Vulcan Materials Company, owner of the premises described herein on Exhibit A hereto, to amend and modify a special use permit for the extraction of sand and gravel granted by Ordinance No. 5991, and subsequently amended by Ordinance Nos. 87-115 and 88-101; and, WHEREAS, said Decatur City Plan Commission did report its findings and did recommend that the modification of said special use permit as requested by authorized. NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1 . That the report and recommendation of the Decatur City Plan Commission be, and the same are hereby, received, placed on file and approved. Section 2. That said Ordinance No. 88-101 be, and the same is hereby modified and amended by substituting Exhibits B and C attached hereto and hereby made a part hereof, for and in lieu of Exhibits B and C, respectively, of said Ordinance No. 88-101, for the purposes of said former Exhibits as therein expressed. � Section 3 . That said Ordinance No. 88-101 be, and the same is hereby further modified and amended by adding Section 4 thereto, said Section 4 to provide as follows: "That if the Director of Public Works determines that airborne dust is not being controlled, then Vulcan shall cease operation until the problem is corrected to the satisfaction of the Director of Public Works. " Section 4 . That except as modified by the provisions hereof, the special use permit heretofore granted by Ordinance No. 5991 and subsequently amended by Ordinance No. 87-115 and 88-101 remains in full force and effect, and the same remains subject to all the conditions, limitations and restrictions set out in the ordinance aforesaid, as amended hereby.
