. <br /> ORDINANCE NO. / ��"� <br /> ORDINANCE APPROVING LAND USE <br /> - CONCRETE/ASPHALT CRUSHING AND RECYCLING CENTER - <br /> 2750 NORTH JASPER STREET <br /> WHEREAS, the following described premises are currently <br /> zoned M-2 Heavy Industrial District: <br /> Lot 1 of Laukaitis Bledsaw Addition as per plat <br /> recorded in Book 1832, page 263 of the records <br /> in the Recorder' s Office of Macon County, Illinois; <br /> and, <br /> WHEREAS, Mid-America Sand and Gravel Co. has petitioned this <br /> Council pursuant to Section XVI (B) of the Zoning Ordinance for <br /> approval to use said premises for a concrete/asphalt crushing and <br /> recycling center; and, <br /> WHEREAS, the use of said premises for said purpose has been <br /> approved by the Building Inspector and the Fire Chief. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1 . That the petition described above, and the <br /> reports of the Building Inspector and the Fire Chief concerning <br /> said petition, be received, placed on file and approved. <br /> Section 2 . That approval be, and it is hereby, granted <br /> to Mid-America Sand and Gravel Co. to operate a concrete/asphalt <br /> crushing and recycling center as described on Exhibit A hereto <br /> and as shown on the site plan of said premises attached hereto, <br /> marked Exhibit B and made a part hereof. <br /> Section 3. That said approval be, and it is hereby, <br /> granted to Mid-America Sand and Gravel Co. , subject to the fol- <br /> lowing conditions: <br /> 1 . Petitioner shall be responsible for solid material en- <br /> tering the City' s storm water system from its facility. If as <br /> determined by the Director of Public Works, and at the discretion <br /> of the Director of Public Works, solid material enters the City' s <br /> storm water system from petitioner' s facility, petitioner shall <br /> cease operation until the problem is corrected to the satisfac- <br /> tion of the Director of Public Works. <br /> 2 . Petitioner shall have at all times, a means to control <br /> airborne dust. If, as determined by the Director of Public <br /> Works, and at the discretion of the Director of Public Works, <br /> airborne dust is not being controlled, petitioner shall cease <br /> operation until the problem is corrected to the satisfaction of <br /> the Director of Public Works. <br />
