, . , ORDINANCE N0. — � � <br /> ORDINANCE ESTABLISHING AND LEVYING A SERVICE CHARGE <br /> FOR THE COLLECTION OF RECYCLABLE MATERIALS <br /> WHEREAS, the City of Decatur is a home rule unit of <br /> government under the provisions of the Constitution of the <br /> State of Illinois; and, <br /> WHEREAS, the Council of said City has decided that it <br /> would be in the public interest to establish a comprehensive <br /> recycling program whereby citizens would have the <br /> opportunity to have recyclable materials collected at their <br /> homes and residences; and, <br /> WHEREAS, the Council, pursuant to said comprehensive <br /> recycling program, has authorized a contract with Waste <br /> Recycling, Inc. and Waste Environmental Services, <br /> Incorporated (jointly, "recycling contractor" ) for the <br /> collection of recyclable materials from all dwellings within <br /> the City; and, <br /> WHEREAS, Chapter 56 . 1 of the City Code authorizes the <br /> imposition of a service charge on the owners of all <br /> dwellings within the City, said service charge to reimburse <br /> the City for its contractually-obligated payments to the <br /> recycling contractor and to provide for other <br /> recycling-related expenses; and, <br /> WHEREAS, the City' s above-referenced contract provides <br /> that the City will pay the recycling contractor the sum of <br /> $1 .05 per month for each occupied dwelling within the City, <br /> the recycling contractor being obligated by such contract to <br /> collect recyclable materials from each such dwelling; and, <br /> WHEREAS, the Council finds that the sum of $ . 20 per <br /> month from each dwelling within the City is necessary to <br /> defray administrative and other expenses related to <br /> recycling. <br /> NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF <br /> THE CITY OF DECATUR, ILLINOIS: <br /> Section 1 . That all words and phrases used in this <br /> Ordinance that are defined in Chapter 56 . 1 of the City Code <br /> shall have the meanings ascribed to them in said Chapter, <br /> otherwise to have their plain and ordinary meanings. <br />
