• . i� <br /> ORDINANCE NO. �I " <br /> ORDINANCE AUTHORIZING LAND ACQUISITION <br /> LAKE DECATUR SEDIMENT DISPOSAL <br /> CITY PROJECT 8919 <br /> WHEREAS, the City of Decatur, Illinois, owns and maintains a <br /> lake commonly known as Lake Decatur which is used by the citizens <br /> of said City for purposes of water supply and recreation; and, <br /> WHEREAS, the Council of said City has decided to build a <br /> dredging storage basin and to dispose of therein sediment dredged <br /> from Lake Decatur for the purposes of increasing the capacity of <br /> �aid Lake for water supply and improving and enhancing the <br /> quality of the water in the said Lake for recreational uses such <br /> as boating, swimming and fishing; and, <br /> . WHEREAS, it is necessary and desirable that suitable lands <br /> in reasonable proximity to Lake Decatur be acquired for said <br /> public purposes; and, <br /> WHEREAS, the premises described in Exhibit A hereto attached <br /> and hereby made a part hereof, are in near proximity of said Lake <br /> Decatur and are suitable for the purpose of said sediment <br />' disposal; and, <br />� WHEREAS, it is necessary that said lands be acquired for the <br /> purposes aforesaid. <br /> NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE <br /> CITY OF DECATUR, ILLINOIS: <br /> Section 1 . That it be, and it is hereby, determined to be <br /> necessary and desirable, in order to carry out the disposal of <br /> sediment dredged from Lake Decatur for the purposes aforesaid, <br /> that the City acquire title to the real property described in <br /> Exhibit A hereto attached and hereby made a part hereof. <br /> Section 2 . That it be and it is hereby determined that the <br /> aforesaid real property and the acquisition thereof is necessary <br /> for a public use and purpose. <br /> Section 3 . That the City Manager and Corporation Counsel, <br /> jointly and severally, be, and they are hereby, authorized and <br /> directed to cause said real property to be acquired on behalf of <br /> the City, and in the event the same is not able to be acquired by <br /> agreement with the owners thereof upon the compensation or <br /> consideration to be paid or furnished for the same, or in the <br />
