f
  LEGAL DEPARTMENT MEMORANDUM
No. 91-7
January 30 , 1991
TO: Honorable Mayor and City Council Members
FROM: James C. Ba , Jr. , City Manager
John W. Cout r, Corporation Counsel
RE: Amendment to Weed-Cutting Ordinance
The City Council has requested that the current City Code
provision regarding the cutting of weeds on public right-of-way
be modified so as not to place an impossible burden on
homeowners. Accordingly, staff has drafted a proposed amendment
• , that seeks to reduce that burden by eliminating the requirement
of cutting in those situations where (1) the slope of the ground
is excessive, or (2) structures existing as of the date of the
ordinance amendment, or unusual topographical conditions, prevent
access to the ground. The amendment also expressly states that
which was administratively determined earlier - that the
weed-cutting requirement only applies to City right-of-way.
This amendment has been reviewed, and supported, by the
Departments of Public Works and Community Development, and is
recommended for approval.
JWC:pm
Attachment I
cc: William B.
