' I • <br /> .� �\ <br /> � <br /> ORDINANCE NO. �I <br /> AN ORDINANCE REVERSING AN ORDER <br /> OF THE BUILDING INSPECTOR <br /> - MEDIAL DRIVE - <br /> WHEREAS, on December 13, 1990, pursuant to notice as <br /> required by statute, the Decatur Zoning Board of Appeals held a <br /> public hearing upon the petition of Woodrow Smith (1) to reverse <br /> the decision of the Building Inspector that the construction of a <br /> proposed detached garage at 34 Medial Drive was not an accessory <br /> building as provided for in the Zoning Ordinance because said <br /> proposed detached garage was larger than the principal building <br /> at said premises, and (2) for variations in the minimum rear yard <br /> set back requirement of seven feet and in the minimum rear yard <br /> coverage of 30$, as per said Zoning Ordinance, to a rear yard set <br /> back of three feet and a rear yard coverage of 50$; and, <br /> WHEREAS, after due consideration and upon an affirmative <br /> vote of less than four (4) members thereof, said Zoning Board of <br /> Appeals did fail to approve the prayer of said petition and did <br /> therefore refuse to reverse the decision of the Building <br /> Inspector or grant said variations; and, <br /> WHEREAS, said Woodrow Smith did timely file an appeal of <br /> said decision with the City Clerk, as per the provisions of <br /> Section XXIII (D) of the Zoning Ordinance. <br /> NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE <br /> CITY OF DECATUR, ILLINOIS: <br /> Section 1 . That the decision of the Decatur Zoning Board of <br /> Appeals upon the aforesaid petition be received and placed on <br /> file, and the decision of the Building Inspector referenced <br /> therein be, and the same is hereby, reversed. <br /> Section 2. That the proposed detached garage to be <br /> constructed at 34 Medial Drive by Woodrow Smith, as shown on <br /> Exhibit A hereto, be, and the same is hereby, approved as an <br /> accessory building and the variations as requested be, and the <br /> same are hereby, granted and approved, and the Building Inspector <br /> be, and he is hereby, authorized and directed to issue a building <br /> permit for same, provided that all other statutes, ordinances, <br /> rules and regulations with regard thereto are properly complied <br /> with. <br />
