Couter, Carporation Counsel <br /> RE: Landmark Mall <br /> The Landmark Mall Maintenance Commission was originally <br /> established in 1971 for a period of ten years. Its purpose was <br /> to maintain the mall through assessments levied against <br /> properties fronting on the mall. It was due to expire, by <br /> statute, in 1980 , but the Council and the property owners agreed <br /> to extend the Commission' s existence for a period of ten years, <br /> through 1990. Accordingly, it is necessary at this time to <br /> further extend the Commission' s jurisdiction, and its authority <br /> to levy assessments. <br /> City staff feels that the Commission has served a useful <br /> purpose in maintaining Landmark Mall, and further feels that the <br /> assessment procedure is an equitable mechanism for so doing. By <br /> law, 66 2/3� of the affected property owners must consent to the <br /> continuation of the Commission. Stafi recommends that the Legal <br /> Department be authorized to file a petition with the Circuit <br /> Court, signed by the requisite number of property owners, seeking <br /> a ten year extension of the Commission. <br />
