O � �� <br /> ORDINANCE PERMITTING COMPUTER CABLE TO <br /> BE PLACED IN, ON OR ACROSS PUBLIC RIGHT-OF-WAY <br /> - K'S MERCHANDISE MART - <br /> BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, <br /> ILLINOIS: <br /> Section 1. That K' s Merchandise Mart, Inc. , ( "K' s") , be, <br /> and it is hereby, authorized and permitted to install and <br /> maintain a computer cable between those premises commonly known <br /> as 326 North Water Street and those premises commonly known as <br /> 301 North Water Street, in, on or across the 300 Block of North <br /> Water Street in the City of Decatur, also known as Landmark Mall, <br /> as �rovided by the terms of this Ordinanc�. <br /> Section 2 . That the authorization an� permission granted <br /> hereby is a revocable license and shall continue in full force <br /> and effect at the will of the Council. Such license is not to be <br /> construed as granting to K' s an easement, a leasehold or any <br /> estate in land or any property right whatsoever, and K' s, by <br /> accepting and utilizing the provisions hereof, waives any right <br /> K' s mav have to any notice or hearing whatsoever prior to the <br /> termination of said license. 'i <br /> Section 3 . That upon the effective date hereof, K' s may I <br /> install the above-referenced computer cable over said Landmark <br /> Mall, at a height of not less than twenty (20) feet and in a <br /> � manner approved by the Department of Public Works. <br /> Section 4. That prior to the aompletion of City Project <br /> 88-09 , at such specific time as is determined by the Department <br /> of Public Works, K' s shall install said computer cable below the <br /> surface of said Landmark Mall, in accordance with plans therefor <br /> approved by the Department of Public Works . <br /> Section 5. That K' s shall be, and shall at all times <br /> remain, liable for th� costs of installation and maintenance of <br /> said computer cable. <br /> Section 6 . That K' s shall execute and provide to the City, <br /> in a form satisfactory �o the Corporation Counsel, an agreement <br />
