'� b �• ORDINANCE NO. b " `7 � ORDINANCE REZONING PROPERTY AND GRANTING SPECIAL PERMIT RESIDENTIAL CARE FACILITY - 4330 E. LAKEWOOD - WHEREAS, on the 5th day of April, 1990 , upon due notice, the Decatur City Plan Commission held a public hearing upon the petition of Scott Cornell to rezone premises described below from R-1 SINGLE FAMILY RESIDENCE DISTRICT to R-3 SINGLE FAMILY RESIDENCE DISTRICT, and for the granting of a special permit under the provisions of Section XXI (A) (1) (t) of the Zoning Ordinance to own and operate a residential care facility, all upon premises legally described as follows: Lots Two (2) , Three (3) and all of Lot Four (4) E:�CEPT the East five feet thereof, in Moses A. Nickey Shore Acres Addition as per Plat recorded in Book 300 Page 88 of the records in the Recorder' s Office of Macon County, Il�ir.ois. WHEREAS, said Decatur City Plan Commission recommended that said rezoning be approved and said special permit be granted. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the recommendations and reports of the Dec�tur City Plan Commission be, and the same are h�reby, received, placed on file and approved. Section 2 . That said described premsies be� and they are hereby, rezoned from R-1 SINGLE FAMILY RESIDENCE DISTRICT to R-3 SINGLE FAMILY RESIDENCE DISTRICT. Section 3 . That upon the conditions hereinafter mentioned, a special permit be, and it is hereby, granted to Scott Corn�ll, and only to Scott Cornell, to own and operate a residential care facility upon the premises aforesaid in accordance with the plat and plan thereof hereto attached marked Exhibit A and hereby made a part hereof. Section 4. That said permit be, and the same is hereby, expressly conditioned as follows:
