D d <br /> ORDINANCE REZONING PROPERTY AND APPROVING <br /> AN R-3 RESIDENCE DFVELOPMENT PLAN <br /> - HICKORY POINT APARTMENTS - <br /> WHEREAS, on the 12th day of December, 1989, upon due nctice, <br /> the Decatur City Plan Commission held. a public hearing upon the <br /> PeLition of Patrick C. Nolan, on behalf c� Roy Mosser, to rezone <br /> premises described as follows: <br /> SEE EXHIBIT A ATTACHED HERETO �ND <br /> . HEREBY MADE A PART HEREOr' <br /> from R-1 Single Family Resider.ce District to R-3 Single Family <br /> Residence District, and for a special permit under the provisions <br /> of Section XXI (C) of the Zoning Ordinance to construct and <br /> operate an R-3 Resider�ce Development Plan on such premises; and, <br /> WHEREAS, said Plan Cor.�unission has reperted to the Council <br /> and has recommended approval of said rezoni:g and Residence <br /> Develapment Plan and that the same be permitted upon the <br /> conditions and limitations hereinafter set out. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINO�S: <br /> Section 1 .
