D d ORDINANCE REZONING PROPERTY AND APPROVING AN R-3 RESIDENCE DFVELOPMENT PLAN - HICKORY POINT APARTMENTS - WHEREAS, on the 12th day of December, 1989, upon due nctice, the Decatur City Plan Commission held. a public hearing upon the PeLition of Patrick C. Nolan, on behalf c� Roy Mosser, to rezone premises described as follows: SEE EXHIBIT A ATTACHED HERETO �ND . HEREBY MADE A PART HEREOr' from R-1 Single Family Resider.ce District to R-3 Single Family Residence District, and for a special permit under the provisions of Section XXI (C) of the Zoning Ordinance to construct and operate an R-3 Resider�ce Development Plan on such premises; and, WHEREAS, said Plan Cor.�unission has reperted to the Council and has recommended approval of said rezoni:g and Residence Develapment Plan and that the same be permitted upon the conditions and limitations hereinafter set out. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINO�S: Section 1 . That the recommendations of the Decatur Citv Plan Commission be, and the same are hereby, received, p�aced on fiZe and approved. Section 2. That said described premises �e, a:�d thEy are hereby, rezoned from R-1 Single Family Residence District to R-3 Single Family Residence District. Section 3 . That upon the cor.ditions and limitations hereinafter set out, a special permit be, and it is hereby, granted to Roy Mosser, and only to Roy P�csser, to de��e.�op, construct and operate ��pon the premises af�resaid an R-3 Residence Development P1an in accordance with the plat ther�of hereto attached, marked �xr.ibiL B ar.d 'nereby ma�e a part r.ereof. Section 4 .
