♦ 3 i � ORDINANCE NO. g / � � v ORDINANCE GRANTING PERMIT FOR R-5 RESIDENCE DEVELOPMENT PLAN - SOUTH FRANKLIN STREET AND IMBODEN DRIVE - WHEREAS, on the 5th day of October, 1989 , upon due notice, the Decatur City Plan Commission held a public hearing upon the petition of Douglas W. Polite, Jr. ( "Petitioner") for a Special Permit under the provisions of Section XXI C. of the Zoning Ordinance to construct and operate an R-5 Residence Development Plan on premises described as: Lot 2 of South Franklin Estates as per Plat recorded in Book 1832 Page 323 of the records in the Recorder' s Office of Macon County, Illinois; and, WHEREAS, said Plan Commission has reported to the Council and has recommended approval of said Residence Development Plan and that the same be permitted upon the cor.ditions and Iimitations hereinafter set out. NO'vV, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1 . That the recommendation and report of the Decatur City Plan Commission be, and the same is hereby, rPceived, placed on file and approved. Section 2. That upon the conditions and limitations hereinafter set out, a Special Permit be, and it is is hereby, granted to Douglas W. Polite, Jr. , and only to Douglas W. Polite, Jr. , to develop, construct and operate upon the premises afo�esaid an R-5 Residence Development Plan in accordance with the plat thereof hereto attached, marked Exhibit A and hereby made a part hereof. Section 3. That the Special Permit authorized hereby be, and the sar.me is hereby, expressly conditioned upon Petitioner performing those duties and obligations assumed by Petitioner in his agreement with the City dated October 24 , 1989 , which agreement is hereby ratified and confirmed by the Council, said agreement being hereto attachAd, marked Exhibi�t B, and hereby made a part hereof.
