• > ORDINANCE NO. � �-' � � ORDINANCE WAIVING LAND USE RESTRICTIONS - 145 EAST DECATUR STREET - WHEREAS, by contract dated November 17 , 1964 , the City of Decatur ("�ity") agreed to sell to Norman Laundry & Dry Cleaning Co. , Inc. ( "Norman' s") that certain parcel of real property commonly known as 145 East Decatur Street, said contract being recorded in Book 1501 Page 329 of the records in the Rec�rder' s Office of Macon County, Illinois; and, WHEREAS, said contract, at paragraph 5 (a) (i) thereof, did restrict the use of said property by Norman' s, and its successors and assigns, to commercial uses as defined in the Urban Renewal Plan adopted by the Council by Resolution No. R180 and recorded at Book 1477 Page 19 of the records in the Recorder' s Office of Macon County, Illinois; and, WHEREAS, Norman' s has used said property in full compliance with the Redevelopment Plan described in the aforesaid contract; and, WHEREAS, Norman' s wishes to hold said property free and clear of the restriction referred to herein; and, , WHEREAS, the City feels that the public health, safety and welfare is adequately served by the restrictions placed upon sair: ', propert� by the Zoning Ordinance and that no further public I benefit is to be derived from the continuation of the contractual restriction referred to herein. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1 . That the restriction as to land use contained in paragraph 5 (a) (i) of the contract hereinabove referred to betweer. the City of Decatur and Norman' s, and its �uccessors and assigns, be, and the same is hereby, waived and surrendered, and the City of Decatur hereby releases Norman' s, and its successors and assigns, from any duty or obligation to car.►ply with said restriction.
