' ��yR• <br /> !{, •�t; :+1 <br /> - _ J <br /> ORDINANCE NO. � --( <br /> ORDINANCE DENYING A VARIANCE <br /> - 1055 EAST LAKEVIEW - <br /> WHEREAS, on December 8, 1988, pursuant to notice as required <br /> by statute, the Decatur Zoning Board of Appeals held a public <br /> hearing upon the petition of William P. Ducy for a variance in <br /> the side yard setback and accessory building separation <br /> requirements of the Zoning Ordinance of the City of Decatur from <br /> five feet to zero feet on the side setback and from eight feet to <br /> four foot eight inches on the accessor� building separation, <br /> upon premises legally described as follows: <br /> Lot 166 of Lakeside Club Addition as per plat recorded <br /> in Book 300 Page 91 of the records in the Recorder' s <br /> Office of Macon County, Illinois; and, <br /> WHEREAS, after due consideration and upon an affirmative <br /> vote of less than five (5) members thereof, said Zoning Board of <br /> Appeals did approve the praver of said petition and did so vary <br /> the provisions of said Zoning Ordinance. <br /> WHEREAS, Richard Hartwig. and others have appealed the <br /> variance of said provisions by the Zoning Board of Appeals <br /> pursuant to Section XXIII of the Zoning Ordinance. <br /> NOW, THEREFORE, BE IT ORDr'�INED BY TEiE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1. That the decision of the Decatur Zoning Board of <br /> Appeals upon the aforesaid petition be received, placed on file <br /> and disapgroved, and that said variance requests be, and they are <br /> hereby, denied. <br /> PRESENTED, PASSED, APPROVED AND R ORDED this 6th day of <br /> February, 1989 . <br /> MAYOR <br /> ATTEST: <br /> CITY CL RK <br />
