� . , ; . ; � �� M{CROFIi�lE� ORDINANCE NO. ORDINANCE VACATING A PORTION OF A STREET AND AN ALLEY - NORTH MERCER STREET - - ALLEY BETWEEN N. MERCER AND N. PI�tE STREETS - WHEREAS, a petition has been received from Frank C. Tyrolt and Bernard L. Naber being the owners of all property abutting thereon, requesting vacatior. of a portion of that certain street in the City of Decatur, Illinois, commonly known as North Mercer Street, and further requesting vacation of a portion of an alley between North Mercer and North Pine Streets in the City of Dzcatur, Illinois, said portions of said street ar_d alley being more particularly described as follows: The North 100 feet of that certain 16 foot alley running North and South between Mercer Street and Pine Street (Block Two of E. B. Durfee' s Second Addition to the City of Decatur as per Plat recorded in Book 22 , Page 499 of the Records in the Recorder' s Office of Macon County, Illinois) , ALSO the North 100 feet of Mercer Street situated to the immediate South of Green Street; and, WHEREAS , the Decatur City Plan Commission held a public hearing upon said petition on January 5 , 1989 and did thereafter recommend to the Council that the prayer of said petition be granted and said portions of said street and alley be vacated as requested; and, WHEREAS, said portions of said street and alley a�e no longer useful to the nublic or to the City or to the owners �f property abutting thereon as a street or alley; and, WHEREAS, the public interest will be subserved by vacating said portior�s of said street and alley and the public will be relie`ved from any further burden or responsibilyty �or maintaining said portions oi said street and alley. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Sectian 1 . That the above-described portions of said street and alley be, and the same are hereby, vacated as a pu�lic street a:sd alley effective and upon zhe exceptions and conditions :�e�-einafter provided, inasmuch as the same are no longer required tor oublic use and the public interest wil'_ be subserved by said vacation, said portions ot said street and alley being sh�wn or. the plat thereof hereto attached and 'nereby made a part hereof.
