MERCER AND N. PINE STREETS — �� 10.0�ch �/ �/ ee��Recorder of beeds WHEREAS, a petition has been received from Frank C. Tyrolt and Bernard L. Naber being the owners of all property abutting thereon, requesting vacation of a portion of that certain street in the City of Decatur, Illinois, commonly known as North Mercer Street, and further requesting vacation of a portion of an alley between North Mercer and North Pine Streets in the City of �ecatur, Illinois, said portior.s of said street and alley being more particularly described as follows : The North 100 feet of that certain 16 foot alley running North and South between Mercer Street and Pine Street (Block Two of E. B. Durfee' s Second Addition to the City of Decatur as per Plat recorded in Book 22, Page 499 of the Records in the Recorder' s Office of Macon County, Illinois) , ALSO the North 100 feet of Mercer Street situated to the immediate South of Green Street; and, WHEREAS, the Decatur City Plan Commission held a public hearing upon said petition on January 5, 1989 and did thereafter recommend to the Council that the prayer of said petition be granted and said portions of said street and alley be vacated as requested; and, WHEREAS, said portions of said street and alley are no longer useful to the public or to the City or to the owners of property abutting thereon as a street or alley; and, WHEREAS, the public interest will be subserved by vacating said portions of said street and alley and the public will be relieved from any further burden or responsibility for maintaining said portions of said street and alley. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS : Section 1 . That the above-described portions of said street and alley be, and the same are hereby, vacated as a public street a:�c� alley effective and upon the exceptions and conditions h��reinafter provided, inasmuch as the same are no longer required for public use and the public interest will be subserved by said vacation, said portions of said street and alley being shown on the plat thereof hereto attached and hereby made a part hereof.
