LEGAL DEPARTMENT MEMORANDUM
No. 88-57
December 1, 1988
TO: James C. Bacon, City Manager
FROM: Georgiana V. Paine
RE: Revisions to Chapter 34
Overtime Parking and Holiday and Week-end Parking
Recently the Police Department notified the Legal Department
that there is no provision in Chapter 34 of the City Code
permitting free parking in metered spaces on Satur.days and
Sundays. It has been our policy to enforce the time restrictions
without requiring payment to the meters, but such was not
reflected in the language of Chapter 34 . (A previous ordinance,
Ordinance No. 84-34, accomplished this purpose, but it was never
included in the Code. ) The revisions to the Code recommended
herein are merely an attempt to codify existing practices and
clarify existing language - no changes are being proposed.
Proposed Section 40 of Chapter 34 will clarify the language
in an existing section of the Traffic chapter of the City Code to
. prohibit "meter feeding" ; that is, remaining parked in a space
longer than the maximum time period indicated on the meter.
Proposed Section 55 (b) of Chapter 34 is designed to
incorporate into the Traffic chapter of the City Code a provision
permitting parking on Saturdays but prohibiting cars from
remaining in a parking space any longer than the maximum time
period indicated on the meter. This section is meant to
facilitate the enforcement of 2-hour meter parking on Saturdays.
With your permission, an ordinance amending Chapter 34 will
be placed on the Council agenda for December 19 , 1988 .
GVP:pm
cc: Deputy Chief Hunk
Phyllis E. Sands
