. 1 <br /> gg --g5 � � <br /> ORDINANCE NO. ``: _�' <br /> ORDINANCE AMENDING RESIDENCE DEVELOPMENT PLAN <br /> AND GRANTING SPECIAL USE PERMIT <br /> WHEREAS, on the lst day of September, 1988 , upon due notice, <br /> the Decatur City Plan Commission held a public hearing on the <br /> petition of Macon Resources, Inc. to amend and modify a part of <br /> the R-3 Residence Development Plan previously approved by <br /> Ordinance No. 4974, said amendment to modify said Residence <br /> Development Plan only as to that portion of the premises <br /> described below so as to allow an eight-bed residential care <br /> facility in place of a four-unit apartment building and to grant <br /> a special use permit under the provisions of Section XXI (A) (1) (t) <br /> of the Zoning Ordinance to operate a residential care facility on <br /> premises commonly known as 3441 Fontenac Court and legally <br /> described as follows: <br /> Lot Twenty-One (21) of Fitzqerald Heights First Addition <br /> as per Plat recorded in Book 1575 Page 14U of the <br /> records in the Recorder' s Office of Macon County, <br /> Illinois; and, <br /> WHEREAS, said Decatur City Plan Commission recommended that � <br /> such Residence Development Plan be modified and amended and said <br /> special use permit be granted as requested. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1 . That the report and recommendation of the <br /> Decatur City Plan Commission be, and the same is hereby, <br /> received, placed on file and approved. <br /> � <br /> Section 2 . That the aforesaid R-3 Residence Development <br /> Plan aforesaid be, and the same is hereby, modified and amended, <br /> and petitioner be, and it is hereby, authorized and permitted to <br /> d <br /> evelop the herein described portion of said Residence <br /> Development Plan as shown on the plat of same attached hereto, <br /> marked Exhibit A and hereby made a part hereof. <br /> Section 3 . That except as modified by the provisions <br /> hereof, the heretofore ordained R-3 Residence Development Plan <br /> remain in full force and effect and the same remain subject to <br /> all the conditions, limitations and restrictions set out in the <br /> ordinance aforesaid. <br />
