, c , ' • <br /> ' � - . <br /> � { �� f � <br /> � ; <br /> t � � � <br /> " � �� amounts received by third parties from Decatur cable customers as a <br /> result of advertising or promoting products on the cable system. <br /> If at any time after the fifth anniversary of this franchise, <br /> federal or state law permits the City to levy a franchise fee <br /> greater than 5� of gross receipts, the City Council may increase the <br /> franchise fee up to the maximum amount established by said law or <br /> regulation. If no maximum amount for franchise fees is established <br /> by said law or regulation, the maximum percentage of gross receipts <br /> used to establish the new franchise fee payment shall not exceed the <br /> combined percentage assessed for state and local sales tax in <br /> Decatur. <br /> Before increasing franchise fees, the City Council shall notify <br /> the Company of its intention to increase franchise fees, and shall <br /> conduct a public meeting and permit the Company and other interested <br /> parties to present comments on the proposed increase. The Company <br /> shall receive sixty (60) days written notice prior to the <br /> implementation of any franchise fee increase. <br /> The Company may identify the franchise fee amount as a separate <br /> line item on the customer bill. This franchise fee amount shall be <br /> the only fees or taxes assessed on the Company or its customers for <br /> cable television service by the City of Decatur. <br /> Section 5. That the Company shall furnish to the City upon <br /> request by it such reports, documents and information reasonably <br /> necessary to enable the City to verify the payments to it by the <br /> Company and shall afford the City the right to from time to time <br /> -3- <br />
