.� . . � i <br /> ORDINANCE N0. 88-30 <br /> ORDINANCE PROVIDING FOR LICENSING OF <br /> RAFFLES AND REPEALING ORDINANCE NO. 81-126 <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, <br /> ILLINOIS: <br /> Section 1 . Whenever used in this Ordinance, the word "Act" <br /> shall mean "AN ACT to provide for licensing and regulating <br /> certain games of chance and amending certain acts herein named" , <br /> Public Act 81-1365, as amended . Words and phrases used herein <br /> shail have the meanings ascribed to them in the Act , unless the <br /> context clearly indicatzs some other meaning is intended . The <br /> word "organization" shall be construed to include an auxiliary or <br /> affiliate of a licensee. <br /> Section 2. The City Clerk shall have the authority to issue <br /> licenses for raffles, as defined in the Act , subject to the <br /> limitatians stated in Section 3 hereof. <br /> Section 3. Licenses for raffles shall be issued only to <br /> bo*�a fide religious, charitable, labor , business, fraternal , <br /> educational or veteran ' s organizations which are located within <br /> the corporate limits of the City of Decatur and which operate <br /> without pr�fit to tl�eir members and which have been in existence <br /> continuously -for a period of five (5) years immediately before <br /> applying for such license and have had during said period a bona <br /> fide membership engaged in carrying out their objects, or to a <br /> non-profit fundraising organization that the City Manager <br /> determines is organized for the sole purpose of providing <br /> financial assistance to an identified individual or group of <br /> individuals suffering extreme financiai hardships as the result <br /> of any illness , disability , accident or disaster . Application <br /> shall be made in writing , no fewer than ten ( 10) days before the <br /> intended sale of raffle chances, on forms provided by the City <br /> Clerk ' s office. Each application shall contain the name and <br /> address of the applicant , the area in which tne raffie chances <br /> will be sold or issued , the time and manner and location of <br /> determining the winning chances, and such other information as <br /> the City Clerk ' s office may reouire. Each application must <br /> contain a sworn statement attesting to the not-for-profit <br /> character of the applicant , signed by its presiding officer and <br /> s2cretary . <br />
