� � � , __ • . � ��t�ROF�LMED oxDiivax� rro.--��l ( AN ORDINANCE GRANTING SPECIAL USE PERMZT - M-2 EXtRACTNE QSE �iEREAS, on the lst day of November, 1974, after notice as re- quired by law and ordinance, the Decatur City P1an Commissi on held a public hearing upon the petition of HOWARD W. ARNOLD for a special use perrait to extract sand and graveZ from premises in the City of Decatur, Illinois, described as set out on Exhibit A hereto attached and hereby made a part hereof; and, WI-�REAS, said Decatur City Pian Commission did report that said proposed use was compatible with the comprehensive plan and would not affect adversely the character and development of the neighborhaod and did reco�nend that said use be permitted upon conditions; and, . �d-�REAS, a site developmeat plan, the requisite operations re- port and a reclamation pZan have been submitted by petitioner. NOIrJ� THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATVR, IL.LINOIS: Section I. That the report and reco�endation of the Decatur Citq Plan Commission be received, placed oa file and appro�ed. Section 2. That the site development plan, �perations report and reclamation plan submitted by petition�r be received and placed on fiZe. Section 3. That upon the can ditions and limitations set out hez�in �or a p�riad of- twenty (20) y�ars, sazd period ending Decem- ber 1, ��4, a sFecial permit be, aad it is hereby, granted HOWARD r W. ARl.'JI.D and �S s�ccessors in title, to use, maintain and operate �he premis�s aforesaid for the purpose of extracting sand and gravel therefrom and for no other use or puxpose e�ept such incidental uses as are found by the Director of Community Develapment to be necessary • to acco�lish such extraction.
