D � IMEQ � �� ORDINANCE AMENDING SPECIAL USE PERMIT - SANITARY DISTRICT - - DIPPER LANE - WHEREAS, on the 6th day of August , 1987 , upon due notice, the Decatur City Plan Commission held a public I hearing on the petition of the Sanitary District of Decatur to amend the Special Use Permit granted by Ordinance No. 4493 to operate a sewage treatment plant and related facilities by modifying and changing the legal description of the premises therein described, and to thereby extend the permitted use onto adjacent premises; and, WHEREAS, said Decatur City Plan Commission did report its findings and did recommend that the modification of said Special Use Permit as requested be authorized. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the report and recommendation of the Decatur City Plan Commission be, and the same is hereby, received, placed on file and approved. Section 2 . That upon the express condition hereinafter mentioned, Ordinance No. 4493 be, and the same is hereby, modified and amended so that the legal description of the premises referred to therein shall now read as shown on Exhibit A attached hereto and hereby made a part hereof, and that permission and authorization be, and it is hereby, granted to the Sanitary District of Decatur to operate a sewage treatment plant and accessory facilities on the premises described on Exhibit A hereto. Section 3. That said amendment and permission be, and the same are hereby, granted upon the express condition that those tracts of land shown as tracts Nos. 1 and 4 on Exhibit A hereto be left as open space and that no buildings or other structures shall be built upon said tracts.
