'" � !7- AN ORDINANCE DENYING A SPECIAL USE - 1724 EAST LAKE SHORE DRIVE - WHEREAS, on August 13, 1987 , pursuant to notice as required by law, the Decatur Zoning Board of Appeals held a public hearing upon the petition of St. Mary' s Hospital for the construction and operation of an off-street parking lot in a residential zone under the provisions of Section XXIII(B ) ( 2 ) (h) of the Zoning Ordinance, upon premises commonly known as 1724 East Lake Shore Drive, and more particularly described as follows : Lot Fifty-five ( 55 ) of Sampson Addition, as per Plat recorded in Book 745 Page 251 of the records in the Recorder' s Office of Macon County, Illinois; and, WHEREAS, after due consideration and upon an affirmative vote of less than five members thereof, said Zoning Board of Appeals did grant the prayer of said petition and did authorize and approve the construction and operation of the off-street parking lot as aforesaid; and, WHEREAS, William Wombacher and Patricia Womacher, interested parties appearing at said Zoning Board of Appeals hearing and objecting to said petition, have timely filed a notice of appeal of said Board' s decision with the City pursuant to the provisions of Section XXIII( D) of the Zoning Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section l. That the decision of the Decatur Zoning Board of Appeals upon the aforesaid petition be, and the same is hereby, expressly disapproved and reversed, and that petitioner be, and it is hereby, denied the right and authority to vary from the provisions o� the Zoning Ordinance as requested in its petition.
