. ! •� <br /> 1 <br /> ORDINANCE NO. � �- / � ���'� <br /> AN ORDINANCE VACATING PORTION OF RIGHT-OF-WAY <br /> CARTER WALLACE, INC. <br /> WHEREAS, a petition has been received from Carter Wallace, <br /> Inc. , the owner of all property abutting thereon requesting <br /> vacation by the City Council of a portion of right-of-way in the <br /> City of Decatur, Illinois , said portion being more particularly <br /> described as : <br /> Beginning at the Southwest corner of Lot 8 , Block 6 of <br /> Prather, Martin & Gatling' s Addition as per Plat <br /> recorded in Book O, Page 553 of the records in the <br /> Recorder' s Office of Macon County, Illinois; thence <br /> Southerly 15.00 feet along the East Right-of-Way line <br /> of North Morgan Street; thence Westerly and parallel to <br /> the North Right-of-Way line of East North Street 5 . 00 <br /> feet ; thence Northerly and parallel to the East Right- <br /> of-Way line of North Morgan Street 15 . 00 feet ; thence <br /> Easterly along the North Right-of-Way line of East <br /> North Street 5 .00 feet to the point of beginning, <br /> containing 0 . 002 acres more or less; and, <br /> WHEREAS, said portion of right-of-way is no longer useful <br /> to the public or to the City or to the owners of property <br /> abutting thereon; and, <br /> WHEREAS, the public interest will be subserved by vacating <br /> said portion of right-of-way and the public will be relieved from <br /> any further burden or responsibility for maintaining said portion <br /> of right-of-way. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1. That the above-described portion of right-of-way <br /> be, and the same is hereby, vacated as public right-of-way, <br /> inasmuch as the same is no longer required for public use and the <br /> public interest will be subserved by said vacation, said portion <br /> of same being shown on the plat thereof hereto attached and <br /> hereby made a part hereof. <br /> Section 2 . That the benefits which will be accrued to the <br /> owner of abutting property by reason of the vacation aforesaid is <br /> determined to be, in the judgment of the Council, equal to the <br /> sum of $45 .00. <br />
