' �' � i. �� MICROFILI� ORDINANCE N0. 87-73 ORDINANCE VACATING PORTION OF STREET DIPPER LANE SANITARY DISTRICT OF DECATUR WHEREAS, a petition has been received from the Sanitary District of Decatur, being the owner of all property abutting thereon, requesting vacation of a portion of that certain street in the City of Decatur, Illinois , commonly known as Dipper Lane said portion of said street being more particularly described as : SEE EXHIBIT A ATTACHED HERETO AND HEREBY MADE A PART HEREOF WHEREAS, the Decatur City Plan Commission held a public hearing upon said petition on April 2 , 1987 and did thereafter recommend to the Council that the prayer of said petition be granted and said portion of said street be vacated as requested; and. ' WHEREAS, said portion of said street is no longer useful to the public or to the City or to the owners of property abutting thereon and the public interest will be subserved by vacating said portion of said street and the public will be relieved from any further burden or responsibility for the opening, improving or maintaining said portion of said street . NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS : Section 1. That the above described portion of said Dipper Lane be, and the same is hereby, vacated as a public street upon the exceptions and conditions hereinafter provided inasmuch as the same is no longer required for public use and the public interest will be subserved by such vacation, said portion of said street being shown on the plat thereof hereto attached and hereby made a part hereof. Section 2 . That there is hereby reserved in, over, along and under the above described portion of said street and alley, I to the City of Decatur, Illinois , and to the public and to those � utilities and companies as the case may be ov,�ning public service I
