' <br /> • , ' P ' <br /> MtCRO���Q <br /> ORD INANCE N0. �— � l-� <br /> �— <br /> ORDINANCE AMENDING ZONING ORDINANCE <br /> - SPECIAL USE PERMITS - <br /> WHEREAS , on the 2nd day of October, and the 5th day of <br /> November , 198b , upon due notice , the Decatur City Plan Commission <br /> held public hearings on the petition of the Director of Community <br /> Development to modify and amend the special use regulations of <br /> the Zoning Ordinance , the same being Ordinance No. 3512 , as <br /> amended, at Section XXI .A. l and XXI .A. 3 thereof so as to <br /> authorize the Council to vary from the requirements of a specific <br /> zoning district when issuing such permits , provided the essential <br /> character and nature of the neighborhood are unchanged, and to <br /> authorize the Council to grant such permits by majority vote ; <br /> and, <br /> WHEREAS , the Decatur City Plan Commission did recommend that <br /> the prayer of said petition be granted and said special use <br /> regulations �e so modified and amended. <br /> NOW, THEREFORE , BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS : <br /> Section 1 . That the recommendation of the Decatur City Plan <br /> Commission be , and the same is hereby, received, placed on file <br /> and approved. <br /> Section 2 . That that portion of Section XXI .A. 1 preceding <br /> subsection (a) thereof and Section XXI .A. 3 of the Zoning <br /> Ordinance be , and the same are hereby, modified and amended so <br /> that as so modified and amended said sections provide as follows : <br /> XXI .A. 1 . <br /> The City Council may by Ordinance grant a special use <br /> permit only for the following special uses in any <br /> district , except as herein qualified , from which they <br /> are otherwise prohibited by this Ordinance , and may <br /> vary the application of otherwise applicable <br /> regulations for such special uses , provided that the <br /> essential character and nature of the surrounding <br /> neighborhood are not disturbed , and may also impose <br /> appropriate conditions and safeguards , including a <br />
